1. The Starting Point: Mandatory Court Fees

Regardless of whether you choose to use a solicitor, there are fixed costs set by the HM Courts & Tribunals Service that must be paid to process the legal paperwork. 

  • Divorce Application Fee: The current fee to file for divorce is £612. This covers the entire process from your initial application through to the Final Order.
  • Financial Consent Order: If you and your spouse have already agreed on how to split your assets, a court fee of approximately £60 is required to make that agreement legally binding.
  • Contested Orders: If you cannot agree and require the court to intervene, fees for a Financial Order application are £313, while Child Arrangement Orders are approximately £263.

2. Solicitor and Legal Fees

Legal fees are separate from court costs and depend entirely on the level of support you need.

  • Fixed-Fee Uncontested Divorce: For straightforward cases where both parties are in agreement, Keelys offer fixed-fee packages. As Applicant your divorce will cost £450 plus VAT (£90) = £540 plus the Court fee. As joint applicant it will cost £600 plus VAT (£120) = £720 plus the Court fee.  As Respondent your divorce will cost £350 plus VAT (£70) = £420.
  • Financial Settlements: Drafting a formal Consent Order.  Keelys offer the following options depending on the complexity of your assets:
    • Consent Order only where assets are not complex (no D81 or correspondence with Court or other side) £900 plus VAT (£180) £1080.
    • Consent Order plus D81 and correspondence with Court and other side.  Non complex assets.  £1250 plus VAT (£250) = £1500 plus Court fee.
    • Consent Order plus D81 and correspondence with Court and other side. Complex assets.  £1750 plus VAT (£350) = £2100 plus Court fee. 
    • Pre nuptial / Post nuptial agreements / Separation agreements: £1500 plus VAT (£300) where not complex total = £1800.
  • Contested Litigation: If your divorce becomes “contested”—meaning you must go to court to resolve disputes—costs can escalate quickly. Depending on the length of the proceedings, fees can reach £15,000 to £30,000+ per person.

3. Reducing Costs through Alternative Dispute Resolution

Avoiding the courtroom is often the most effective way to keep your total costs down.  Keelys are able to provide alternative dispute resolution in the form of Collaborative Law.  This would mean you sitting down with your own Solicitor (Julie Slater-Williams) from Keelys and your spouse and their collaborative Lawyer in the same room over a series of meetings.  You would commit to resolving the issues relating to your divorce in that forum and with the help of both solicitors in a constructive and proactive way.  This would prevent Court proceedings from having to be issued and your divorce would be dealt with by correspondence with the Court only and with both Solicitors assisting in the negotiation and finalisation of the orders.
