You have your judgment but how do you turn that judgment into money?

There are a number of options, upon which we can advise.  Commonly. These include:

Serving a Statutory Demand;

  • Getting a Charging Order (a charge on property) which protects your judgment by making you a secured creditor;
  • Getting a Third Party Debt Order;
  • An attachment of Earnings Order.

Sending in the bailiff can also be an effective method of enforcement, but what is the difference between a Bailiffs and the High Court Enforcement Officer?

For judgments under £600 you cannot use a High Court Enforcement Officer (“HCE”) and so we would instruct a County Court Bailiff by issuing a Warrant of Control.

For judgments over £600 we recommend instructing a HCE. Why? – Because the collection rates are higher and a HCE has greater powers of enforcement. We can transfer the judgment from the County Court to the High Court and issue a Writ of Control and send the Writ to our preferred private bailiffs authorised by the Ministry of Justice
